Terms of Purchase
Welcome to SJIOBA Online Shop and Events/Seminars Bookings.
The Terms of Purchase shall apply to you when you purchase products (the “Products”) or book for events or seminars or any other services (the “Events”) using www.sjioba.org (the “Website”) and the SJIOBA App (the “App”) that are operated by St. Joseph's Institution Old Boys' Association (“SJIOBA”, “we”, “us”. “our”). The term “Order” will be used to refer to the Products you have purchased and/or Events booked by you. The term “Tickets” will be used to refer to Events where tickets are issued. Please read the Terms of Purchase carefully before placing an Order on the Website or the App.
By placing an Order on the Website or the App, you agree that you have read the Terms of Purchase in full and you accept and agree to be bound by them. You must not place an Order on the Website or the App if you have any objections to any clauses in the Terms of Purchase.
The Terms of Purchase may be amended from time to time without liability and without prior notice to you. The amended Terms of Purchase will be posted on the Website and/or the App and will take effect from the date it was posted. You should regularly check the Terms of Purchase for updates before placing an Order on the Website or the App.
You waive any right to receive specific notice of each amendment to the Terms of Purchase. It is your responsibility to periodically review the Terms of Purchase to stay informed of updates. If you place an Order on the Website and the App after the amended Terms of Purchase have been posted, it will be deemed that you are aware of and have accepted the changes in the amended Terms of Purchase.
The Website and the App is provided “as is” with all faults and we make no expressed or implied representations or warranties to the accuracy, applicability, suitability and completeness of the materials and contents on the Website and the App and we are not liable for any loss or damage arising from your use of the Website and the App and the information or materials posted by advertisers and sponsors. Nothing contained on the Website and the App shall be construed as providing consult or advice to you.
We do not warrant that the Website and the App and its functions will be accessible at all times and will remain uninterrupted or error and defect free.
We will not be liable for any loss, damage, costs, expense delays or any other liabilities which you may have incurred that is beyond our reasonable control including but not limited to any failure of communication, computer or other facilities or the inability for you to access the Website and the App for any reasons or any failure or error in sending and receiving any communications, notices or instructions through the post or electronic means.
You agree to indemnify us to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses including but not limited to legal fees arising out of or in any way related to your breach of any of the clauses in the Terms of Purchase.
Intellectual Property Rights
Unless otherwise stated, we and/or our licensors own the intellectual property rights for all contents and materials on the Website and the App. All intellectual property rights are reserved. You may access this from the Website and the App for your own personal use subjected to restrictions. You should not republish, sell, rent, sub-license, reproduce, upload, store, post, duplicate, copy, alter, amend, display in public or redistribute the materials, contents or any part of the Website and the App without our written consent. You may however download any materials or contents from the Website and the App for home use, non-commercial use as long as all copyright and trademarks remain intact.
Products, Events and Prices
We make every effort to display as accurately as possible the details, such as the colours, features and specifications of the Products and Events available on the Website and the App. However, there may be errors in the details of the Products and Events and your electronic display may not accurately reflect the actual colours and details of the Products and Events.
All Products and Events are subject to availability and we cannot guarantee that the Products and Events you ordered will be in stock. We reserve the right to discontinue any Products and Events at any time for any reason without prejudice and without prior notice to you.
Tickets may be issued for certain Events that you have booked. Please read the Terms and Conditions for the Events that you have booked if applicable.
We make our best effort to ensure that the prices of our Products and Events shown on the Website and the App are correct. However, despite our best efforts there may be errors in the pricing. If the correct price is less than the stated price, we will charge the lower price. If the correct price is higher than the stated price, we will contact you for instructions before confirming and delivering your order or we may reject your order and notify you of such rejection.
The prices may change from time to time without prior notice to you. The change in prices will not affect the Orders that have been placed and paid for.
Prices may include GST if applicable but does not include delivery fees. The delivery fees and any other fees if applicable will be reflected in your checkout basket depending on the delivery method you have chosen.
Placing an Order
By placing an Order on the Website or the App, you warrant that you are:
At least 21 years old and if you are below 21 years old, you have obtained consent from your parents or legal guardian to place an Order.
You are authorised to use the account to place an Order.
Your place of resident is in Singapore.
A valid email address and contact number is required for us to be able to contact you if necessary.
After placing an Order, you will receive an order confirmation email which would contain the details of your Order. This order confirmation email is not an acceptance of the Order that you have placed.
Your Order is subjected to availability. You will be contacted if the Products or Events are not available.
We reserve the right to refuse your Order placed through the Website or the App. We may at our sole discretion, limit or cancel quantities of the purchased Products or Events by per person, per household, or per order. These restrictions may include but is not limited to Orders placed by or under the same member account, payment method and/or billing or shipping address. We reserve the right to limit or prohibit Orders that appear to be placed by dealers, resellers, or distributors.
Payment for all Orders must be made through Paypal on the checkout page. All payments are in Singapore Dollars unless otherwise stated on the Website and the App.
We are not responsible if your card issuer declines to authorise your payment or charges you for online handling fee or processing fee.
You agree to pay the charges for your Order, any applicable delivery fees and any other fees if applicable when you checkout your Order.
If your Order has recurring charges, then you consent for us to charge you on a recurring basis without requiring your prior approval for each recurring charge until such time as you cancel the applicable Order. Cancellation must be made one (1) month before the next recurring charge is due.
Title of the Products and Events will pass to you only after payment have been received by us.
There will be a delivery fee for delivery to a single address within Singapore. An additional fee may be required for delivery to certain locations such as but not limited to Sentosa. The delivery fee may change from time to time without prior notice to you, however, such changes in delivery fees will not affect the Orders that have already been placed, accepted and paid. We do not ship internationally.
The delivery will be made by third party delivery companies such as Singpost or any other delivery company that is appointed by us.
Delivery can only be made to a valid address. We cannot deliver to a P.O. Box address.
The Order will be delivered to the delivery address within 7-10 working days, with the exception where an Order may have Products that are unavailable. Products will be released when stock is made available.
For Events where tickets are issued, the tickets will be delivered or emailed to you when it is available.
If you would like to collect your Order, please email email@example.com to make arrangements for collection. Collection can only be made on weekdays during office hours and with an appointment.
We or our appointed delivery company will deliver the Order on the understanding that whoever receives the Products and/or Tickets at the delivery address is authorized to receive the Products and/or Tickets. A signature of the person accepting the Products and/or Tickets as proof of delivery may be required.
Returns, Cancellations and Refunds
Return of Products must be made within 14 days from the date of receiving the Products and it must be in its original packaging if applicable. We will not accept return of Products that have been opened. Accepting returned Products is at our sole discretion.
For cancellation of Events, please check the cancellation terms for the Events that you have booked. Different Events may have different cancellation terms. Accepting the cancellation of Events is at our sole discretion.
For all returns, cancellations and refunds please email us at firstname.lastname@example.org. Refunds will be made only after we have received the returned Products and Tickets if applicable. Return postage and handling costs will not be covered by us. You are responsible for the costs associated with returning the Products and Tickets to us.
If you would like to return your Products and Tickets personally, please email email@example.com to make arrangements. Returning your Products and Tickets can only be made on weekdays during office hours and with an appointment.
If you wish to return your Products and Tickets, it must be returned with the invoice which was emailed to you after the completion of your Order.
If any of the clauses of the Terms of Purchase are found to be unenforceable or invalid by a competent authority, such clauses shall be amended to the extent necessary to make it enforceable and valid and the remaining clauses that are enforceable and valid shall remain enforceable and valid.
If you have breached any of the Terms of Purchase and we have not taken any action against you, it does not in any way mean or imply that we have waived our rights against you. We will still be entitled to exercise our rights and seek remedies against you at a later time or in any other situation where another breach of the Terms of Purchase have been committed by you.
The Terms of Purchase constitutes the entire agreement between us and you in relation to the purchase of Products and bookings of Events and supersedes all prior agreements and understandings with respect to the same.
We will not be responsible for any failure or delays to comply with the Terms of Purchase if such failure and delays are caused by events that are beyond our control. Events such as but not limited to floods, fires, storms, earthquakes, natural disasters, war, civil unrest, terrorism, or malicious damage or destruction caused to our office, equipment and products.
In the event of a dispute, please contact us at firstname.lastname@example.org to resolve the dispute informally with us.
Governing Laws and Jurisdiction
The Terms of Purchase shall be governed by and construed in accordance with the laws of the Republic of Singapore.
