General
The Terms of Use shall apply to you when you access and/or use www.sjioba.org (the “Website”) and the SJIOBA App (the “App”) that are operated by St. Joseph's Institution Old Boys' Association (“SJIOBA”, “we”, “us”. “our”). Please read the Terms of Use carefully before using the Website and the App.

By accessing the Website or the App or any part of it, you agree that you have read the Terms of Use in full and you accept and agree to be bound by them. You must not use the Website or the App if you have any objections to any clauses in the Terms of Use.

The Terms of Use may be amended from time to time without liability and without prior notice to you. The amended Terms of Use will be posted on the Website and/or the App and will take effect from the date it was posted. We may also from time to time post additional rules and guidelines on the use of the Website and the App, and such rules and guidelines are deem to form part of the Terms of Use. If you decide to purchase our products and/or book events and seminars on the Website or the App, you should also read the Terms of Purchase as it will also apply to you. You should regularly check the Terms of Use for updates before using the Website and the App.

You waive any right to receive specific notice of each amendment to the Terms of Use. It is your responsibility to periodically review these Terms of Use to stay informed of updates. If you continue to use of the Website and the App after the amended Terms of Use have been posted, it will be deemed that you are aware of and have accepted the changes in the amended Terms of Use.

The Terms of Use is to be read together with the Privacy Policy and Terms of Purchase.

The Website and the App are intended for use in Singapore. It is not intended for use in any jurisdiction or country where such use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. If you choose to use the Website and the App from other locations, you are solely responsible for compliance with that location’s local laws, if applicable.

User Account
If you are the owner of an account on the Website and/or the App, you are solely responsible for maintaining the confidentiality of your username and password and for restricting access to your computer and mobile phone. You are responsible for all activities that occur under your account or password.

By signing up for an account or requesting us to register/activate your account, you warrant that you are:

At least 18 years old and if you are below 18 years old, you have obtained consent from your parents or legal guardian and you are under their supervision.
The personal data that you have provided is your actual identity and that it is accurate, current and complete.
You agree to maintain and update your personal date with us so as to ensure that your personal data with us is current, accurate and complete.

Certain areas of the Website and the App are restricted from access to you and we may further restrict access to you to any areas of the Website and the App, at any time, at our sole discretion without prejudice and without prior notice to you.

We reserve all rights to terminate your account, edit or remove comments and contents and cancel orders at our sole discretion without prejudice and without prior notice to you. In addition to terminating your account, we may take other actions such as but not limited to reporting you to the police, or other law enforcement authorities or issue a warning to you, or take legal action against you and claiming all legal cost from you.

Reasons for such termination includes but is not limited to:

Breach of the Terms of Use.
Infringement of Intellectual Property rights.
Unforeseen technical and security issues.

Warranties
The Website and the App is provided “as is” with all faults and we make no expressed or implied representations or warranties to the accuracy, applicability, suitability and completeness of the materials and contents on the Website and the App and we are not liable for any loss or damage arising from your use of the Website and the App and the information or materials posted by advertisers and sponsors. Nothing contained on the Website and the App shall be construed as providing consult or advice to you.

We do not warrant that the Website and the App and its functions will be accessible at all times and will remain uninterrupted or error and defect free.

We will not be liable for any loss, damage, costs, expense delays or any other liabilities which you may have incurred that is beyond our reasonable control including but not limited to any failure of communication, computer or other facilities or the inability for you to access the Website and the App for any reasons or any failure or error in sending and receiving any communications, notices or instructions through the post or electronic means.

We, including any of our officers, directors and employees shall not be liable to you for anything arising out of or in any way connected with your use of the Website and the App whether such liability is under contract, tort or otherwise.

You agree to indemnify us to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses including but not limited to legal fees arising out of or in any way related to your breach of any of the clauses in the Terms of Use.

Intellectual Property Rights
Unless otherwise stated, we and/or our licensors own the intellectual property rights for all contents and materials on the Website and the App. All intellectual property rights are reserved. You may access this from the Website and the App for your own personal use subjected to restrictions set in the Terms of Use. You should not republish, sell, rent, sub-license, reproduce, upload, store, post, duplicate, copy, alter, amend, display in public or redistribute the materials, contents or any part of the Website and the App without our written consent. You may however download any materials or contents from the Website and the App for home use, non-commercial use as long as all copyright and trademarks remain intact.

Parts of the Website and the App may offer an opportunity for you to post and exchange opinions and information. We do not filter, edit, publish or review comments prior to their presence on the Website and the App. These comments do not reflect the views and opinions of SJIOBA, its agents and/or affiliates. These comments reflect the views and opinions of the person who posted their views and opinions. We shall not be liable for the comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the comments on the Website and the App.

We reserves the right to monitor all comments and to remove any comments which can be considered inappropriate, offensive or causes breach of the Terms of Use without prejudice and without prior notice.

You warrant and represent that:

You are entitled to post your comments and contents on the Website and the App and have all necessary licenses and consents to do so.
The comments and contents do not invade any intellectual property rights, including without limitation copyright, patent or trademark of any third party.
The comments and contents do not contain any defamatory, libellous, offensive, indecent or otherwise unlawful material which is an invasion of privacy.

The Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore.
